In this age of digital media, the law mandates government agencies, public and private institutions and companies, and even ordinary citizens of the republic to protect and respect data privacy and personal information. But how exactly is this going to be done?
Republic Act No. 10173, or otherwise known as the Data Privacy Act of 2012, aims to “protect the fundamental human right of privacy, of communication while ensuring free flow of information to promote innovation and growth” as stated on Chapter 1, Section 2 of the law. It also stresses the role of information and communications technology to ensure that personal information under the custody of the government and private sector are secured.
The National Privacy Commission, or the NPC, is the independent agency tasked to administer and implement the compliance to the Data Privacy Act of 2012. To fully promote the guidelines and procedures on how to comply with the law, the NPC established the 5 Pillars of Compliance. These shall be the key steps to be followed by government agencies and businesses on its journey to DPA Compliance.

One of the NPC’s marching others was to set a September 9, 2017 deadline for companies and institutions to comply with Step 1, which is to Appoint a Data Protection Officer and duly register it to the commission. Failure to do so or even a late registration may subject a company or an institution to an early compliance check. That means, the commission will specifically target these companies and agencies since failure to do Step 1 may be considered negligence already on their part or lack of due diligence to comply with the law.
